Terms of Service

These Terms of Service (the "Terms") set forth the conditions for use of this service (including this website, and hereinafter, we do not distinguish between the two). These Terms apply to all users of this service.

Agreement to Terms

By using this service, users are deemed to have given valid and irrevocable consent to these Terms. Users who do not agree to these Terms may not use this service.

User Registration

Those who wish to use this service may register by applying for registration through the method specified by us after agreeing to these Terms, and upon our approval.

Registration Refusal

Use by Minors

If you are a minor, please use this service after obtaining the consent of your legal guardian. Please also obtain the consent of your legal guardian before using smartphones or other devices necessary to use this service.

If a user who started using this service without obtaining the consent of a legal guardian reaches the age of majority, we will consider that the user has ratified the use during the period when they were a minor.

Management of Login Information

Users shall manage their login information for this service at their own responsibility. Users may not transfer, lend, or share their login information with third parties under any circumstances. We shall not be liable for any damage caused by the use of login information by third parties, except in cases of our willful misconduct or gross negligence.

Use of Content

We grant users permission to use the text, images, videos, audio, music, software, programs, code, and other content provided by this service for private use within the scope of use of this service. For paid content, we grant permission for private use within the scope of use of this service upon completion of payment of the usage fee specified by us. This is a non-exclusive license that cannot be transferred or sublicensed. Any use of content provided by this service beyond this scope is prohibited.

Users agree in advance that if they lose the right to use this service for any reason, they will no longer be able to use any content of this service.

Points

We may issue points unique to us or this service. Details in such cases shall be separately specified in this service or other places designated by us.

Virtual Currency

We may issue virtual currency (hereinafter referred to as "this virtual currency") unique to us or this service.

Default Interest

Users who delay payment of monetary obligations to us shall pay default interest at a rate of 14.6% per annum to us.

User Submissions

Users represent and warrant to us that they have the legal right to transmit information contained in their submissions, and that their submissions do not infringe the intellectual property rights (including copyrights, patents, utility model rights, trademark rights, design rights (including rights to acquire such rights or to file applications for registration of such rights), ideas, know-how, etc., and the same shall apply hereinafter), ownership rights, or other rights of third parties.

Copyrights in user submissions remain with the users themselves. We do not acquire copyrights in user submissions. However, we may reproduce, adapt, automatically transmit to the public, and make transmittable for such purposes, user submissions, free of charge, indefinitely, and without geographical limitation, to the extent necessary for the provision, maintenance, improvement, or promotion of this service. In such cases, users shall not exercise moral rights against us and those who have succeeded to or been licensed rights from us.

Users must back up their submissions at their own responsibility. We have no obligation to back up user submissions.

Users must not submit information that falls under any of the following:

• Information that infringes the intellectual property rights, portrait rights, privacy, honor, or other rights or interests of us or third parties
• Information containing personally identifiable information (except when required for registration or otherwise approved by us)
• Information containing obscene expressions
• Information aimed at meeting or engaging in obscene acts with third parties, regardless of gender, with whom the user is not acquainted
• Information containing expressions that induce, solicit, or promote suicide or self-harm
• Information regarding the sale or purchase of drugs or dangerous drugs, or information containing expressions that promote inappropriate use of drugs or dangerous drugs
• Information regarding the promotion or advertising of religious activities, religious organizations, political activities, or political organizations
• Information regarding network business-related solicitations
• Information containing text equivalent to junk mail or spam mail
• Information that may have a negative impact on minors
• Information containing cruel expressions or other information that may cause discomfort to others
• Information containing malicious programs such as computer viruses
• Other information that we determine to be inappropriate

Prohibited Acts

Users must not engage in the following acts when using this service:

• Acts that violate laws, court judgments, decisions, or orders, or administrative measures that are legally binding, or acts that promote such violations
• Acts related to criminal activities
• Acts that infringe the intellectual property rights of us or third parties
• Acts that infringe the portrait rights, privacy, honor, or other rights or interests of us or third parties
• Acts that place an excessive burden on the servers or networks of us or third parties, or interfere with their normal operation
• Acts that may interfere with the operation of our services
• Acts of unauthorized access or attempts thereof
• Acts of analyzing the source code of this service through reverse assembly, reverse compilation, reverse engineering, etc.
• Acts of unauthorized access to systems connected to this service or unauthorized rewriting or deletion of information stored on our equipment
• Acts of reproducing, transmitting, transferring, lending, or modifying the website or software of this service
• Acts of lending, transferring, selling, or otherwise dealing with accounts or content on this service to third parties for compensation
• Acts of commercially using information obtained through this service
• Acts aimed at obtaining profits related to this service through methods not intended by us
• Advertising, promotion, solicitation, or business activities on this service that are not permitted by us
• Acts of collecting or accumulating personal information about other users
• Acts of using this service for illegal, unauthorized, or improper purposes
• Acts that cause disadvantage, damage, or discomfort to other users of this service or other third parties
• Acts of impersonating other users
• Acts of using other users' accounts
• Acts aimed at meeting persons of the opposite sex with whom one is not acquainted
• Acts of providing benefits directly or indirectly to anti-social forces
• Acts that violate public order and morals
• Acts of using this service while walking, driving a vehicle, or in other situations or manners where use of this service is inappropriate
• Other acts that we determine to be inappropriate

Prohibition of Monetization

All content or this virtual currency obtained within this service is strictly prohibited from the following transactions, regardless of the method:

• Sale or purchase
• Any transfer, acceptance, lending, borrowing, etc. in exchange for money or other consideration
• Any other acts that we determine to constitute monetization

Exclusion of Anti-Social Forces

Users represent and warrant that they do not fall under any of the following items, and that they will not fall under any of them in the future:

• That they themselves (or, in the case of corporations or other organizations, including their officers) are organized crime groups, members of organized crime groups, persons who have not passed five years since ceasing to be members of organized crime groups, quasi-members of organized crime groups, companies related to organized crime groups, corporate racketeers, groups or persons engaged in fraudulent business activities under the pretext of social movements, special intellectual violent groups, or other persons equivalent to these (hereinafter collectively referred to as "organized crime group members, etc.")
• That, in the case where the user is a corporation or other organization, they have a relationship in which organized crime group members, etc. are recognized as controlling management
• That, in the case where the user is a corporation or other organization, they have a relationship in which organized crime group members, etc. are recognized as substantially involved in management
• That they have a relationship in which organized crime group members, etc. are recognized as being used, such as for the purpose of seeking unjust profits for themselves or third parties or causing damage to third parties
• That they have a relationship in which they are recognized as being involved, such as by providing funds or other benefits to organized crime group members, etc.
• That, in the case where the user is a corporation or other organization, their officers or persons substantially involved in their management have a socially reprehensible relationship with organized crime group members, etc.

Users warrant that they will not engage in any of the following acts, either directly or through third parties:

• Violent demands
• Unjust demands beyond legal responsibility
• Acts of using threatening words or actions or violence in connection with transactions
• Acts of spreading rumors, using fraudulent means, or using force to damage our credit or interfere with our business
• Other acts equivalent to the preceding items

Use Restrictions

We may restrict all or part of the use of this service or cancel a user's registration without prior notice if the user falls under any of the following. We shall not be liable for any damage caused to users by actions we take based on this provision.

• When the user violates any provision of these Terms
• When it is found that false information has been registered
• When there is a default on monetary obligations
• When there is no response to our communications for a considerable period
• When this service has not been used for a considerable period since the last use
• When we determine that the user is an anti-social force or has some exchange or involvement with anti-social forces
• When we otherwise determine that use of this service is inappropriate

Suspension of Service Provision

We may suspend or interrupt all or part of the provision of this service without prior notice to users if we determine that any of the following applies. We shall not be liable for any disadvantage or damage suffered by users or third parties in such cases.

• When performing maintenance, inspection, or updates of the computer system related to this service
• When provision of this service becomes difficult due to force majeure such as earthquakes, lightning, fires, power outages, natural disasters, or the spread of viruses
• When computers or communication lines are stopped due to accidents
• When we otherwise determine that provision of this service is difficult

Withdrawal

Users may cancel their registration and withdraw from this service through the procedures specified by us.

Disclaimer of Warranty

We do not warrant that this service or the content provided by this service does not contain system bugs or infringement of third-party rights. We also do not warrant safety, reliability, accuracy, completeness, validity, or fitness for a particular purpose.

Limitation of Liability

We shall not be liable for any damage incurred by users in connection with this service. However, this limitation of liability does not apply when the contract between us and the user regarding this service (including these Terms) constitutes a consumer contract under the Consumer Contract Act.

Even when it constitutes a consumer contract, we shall only be liable for compensation for damage directly and actually incurred by users due to our negligence (excluding gross negligence), and the amount of compensation shall be limited to the lower of the usage fee for this service for the most recent one month or 10,000 yen.

Changes to Service Content

We may change the content of this service or suspend or terminate the provision of this service without notice to users. Users agree in advance and without objection that if this service is terminated, they will lose all rights to use paid content and will no longer be able to use such paid content thereafter. We shall not be liable for any damage caused to users by these actions.

Changes to Terms

We may change these Terms at any time without notice to users. The revised Terms shall take effect from the time they are posted on our website. Users who continue to use this service after the revision of these Terms shall be deemed to have agreed to the revised Terms.

Handling of Personal Information

Personal information of users obtained through the use of this service shall be handled appropriately in accordance with our Privacy Policy.

Notices or Communications

Notices or communications between users and us shall be made by the method specified by us. We shall send notices or communications to the currently registered contact information, which we shall deem valid unless we receive a change notification in the separately specified format from the user, and these shall be deemed to have reached the user at the time of transmission.

Assignment of Rights and Obligations

Users may not assign their position under the usage contract or rights or obligations under these Terms to third parties or use them as collateral without our prior written consent.

Business Transfer

If we transfer the business related to this service to another company (including business transfer, corporate split, and any other case where the business is transferred), we may transfer the position under the usage contract, rights and obligations under these Terms, and user information to the transferee of such business transfer. Users shall be deemed to have agreed to such transfer in advance.

Applicable Relationship

These Terms shall apply to all relationships between users and us regarding the use of this service.

We may establish rules for the use of this service in addition to these Terms. These rules shall constitute part of these Terms regardless of their name. If these Terms conflict with these rules, these rules shall take precedence.

Severability

Even if any provision or part of these Terms is determined to be invalid or unenforceable, such determination shall not affect other parts, and the remaining provisions of these Terms shall continue to be valid and enforceable.

Governing Law and Jurisdiction

The interpretation of these Terms shall be governed by Japanese law.

If a dispute arises regarding this service, the district court having jurisdiction over the location of our head office shall be the exclusive agreed jurisdiction.
